1                 General information 

The web shop found on the web site [workwear-usa.com] (the “Web Shop”) is run by Workwear-USA LLC, 4300 West Old US Highway 441, Mount Dora, FL 32757.

If you are below 18 years of age you need permission from your guardian to place an order in the Web Shop. By using the Web Shop and/or placing an order, you accept these general terms and conditions (the ”General Terms and Conditions”).

Workwear-USA LLC reserves the right to – from time to time – amend these General Terms and Conditions and any changes Workwear-USA LLC makes will enter into force no earlier than thirty (30) days after the revised General Terms and Conditions have been made available on the Web Shop.

2                 Prices and delivery charges 

All prices shown in the Web Shop do not include TAX or delivery charges (see exact charges below). No additional taxes or charges, other than those listed on your order or mentioned in these General Terms and Conditions, will be added when you complete your purchase.

Further, Workwear-USA LLC reserves the right to correct pricing errors and adjust prices in case of exchange rate fluctuations which make listed prices incorrect. Workwear-USA LLC Inc also reserves the right to make running adjustments to prices and cancel products and/or orders in case stock of particular products is sold out.

Periodic sales and/or campaign offers are valid unless otherwise stated, as long as the products are available in stock and/or until the end date is reached under the terms specified in each offer/campaign.

Delivery Charges

Your delivery charge will be specified during checkout. You may qualify for a discounted shipping cost depending on other applicable discounts at the time of your order.

3                Tax Policy

Tax charges are based on applicable federal, provincial and harmonized sales tax rates based on the delivery address associated with your order. Where required, sales tax will also be applied to the shipping and handling charges. If you return an item for a refund, you will also receive a refund for the sales taxes you paid for that item.
Tax Exempt

If you are making a purchase for a tax-exempt organization or are an individual that qualifies for a tax exemption, please contact our Customer Service team at order@workwear-usa.com. To ensure compliance with federal and provincial tax laws, all requested forms and information must be received and verified by our Customer Service team before a tax refund can be processed.

4                 Ordering and confirmation of purchase 

After you have made a purchase you will receive a confirmation of the purchase to the e-mail address provided by you at the time of the placing of your order. The confirmation will be sent to you within reasonable time and no later than at the time of delivery of the purchased product/s. You will receive a confirmation within a day of order being processed. If an item is on back order you will be contacted to see if you would still like to proceed with your order.

5                 Delivery 

Workwear-USA LLC delivers its products to the US. All parcels will be sent via UPS or equivalent. Parcels are delivered to the address specified when placed order.

Workwear-USA LLC’s aim is to always deliver your purchased product(s) as quickly as possible. If your product is available in stock, the products will ship within 24-48 hours of being placed, normal delivery time is between 7-10 days. The delivery time is counted from the time of order placement until the purchased product is delivered to you. Delivery times may vary depending on border crossing and weather.

If the product that you have purchased is not available in stock or delays are caused due to other circumstances, delivery times may be longer. Even though Workwear-USA LLC aims to deliver the product that you have purchased within the communicated time frame, delivery may take longer. Workwear-USA LLC will inform you, without delay and as soon as possible.

6                 UNDELIVERABLE parcels 

If the address you provided is incorrect and your order cannot be delivered Workwear-USA LLC will charge you for the actual costs for freight charges and return freight charges. Workwear-USA LLC cannot ship to a PO BOX’s.

7                Payment methods and safety 

Payment can be made with the following valid credit or debit cards: Visa, MasterCard.

When you pay by card, the transaction is processed by PayPal in order to ensure fast and secure payment which meets the PCI-DSS requirements. Workwear-USA LLC does not save your card details. All information is encrypted and sent to PayPal via secure servers (SSL/HTTPS). Workwear-USA LLC reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. Workwear-USA LLC may refuse orders depending on the result of these controls.

8               Cancellations, replacements and complaints 

Please note that if you wish to cancel, replace or complain about a product that you have purchased, you stand the risk for the transportation of the product back to Workwear-USA LLC. This means that you are responsible for any damage or loss of the product during the transportation of the product to Workwear-USA LLC. Workwear-USA LLC recommends you to always save the receipt until the return of your product has been completed.

Cancellations and replacements

If you are not satisfied with the product that you have purchased, you have the right to return the purchase within thirty (30) days from the date of receipt of the product.

If you choose to return your purchased product, Workwear-USA LLC will refund what you have paid, excluding any freight and delivery charges for delivery to you, also, any return charges will be withdrawn from the amount refunded. If you choose to cancel/return only part of your order Workwear-USA LLC will not refund any delivery charges, since the same charges apply no matter how many products you order. The refund will be made as soon as possible and within thirty (30) days from Workwear-USA LLC’s receipt of your message regarding cancellation, provided that Workwear-USA LLC, by this date, has received the product that you would like to return or that you have provided Workwear-USA LLC with a proof of the product being sent to Workwear-USA LLC. Orders returned that shipped at no cost for the customer shall have the regular shipping cost ($24.95) deducted from their refund. If the order has shipped the customer is responsible for the initial shipping charge(s), return shipping charge(s), and all related expenses related to returning the order.

Please note that Workwear-USA LLC will not compensate you for any return freight charges. Further, if your handling of the product that you have purchased has resulted in a decreased value of the product, Workwear-USA LLC will make a deduction of the refund corresponding to the amount of the loss of value of the product. There is a minimum re-stocking fee of 25% for items returned with the tags removed from the product.

If you request a replacement of your purchased product and Workwear-USA LLC has the replacement product in stock, Workwear-USA LLC will ship the replacement product within 5 working days from the date of Workwear-USA LLC ‘s receipt of the returned product. Workwear-USA LLC will only compensate you for the return freight charges if the product is faulty or if it has been delivered to you by mistake.

9                Links 

The Web Shop may, from time to time, contain links to or from other web sites, which are not controlled by Workwear-USA LLC. Although Workwear-USA LLC will do its utmost to make sure that the links on the Web Shop only transfers you to web sites which share Workwear-USA LLC’s safety and confidentiality standards, Workwear-USA LLC cannot be held responsible for the protection or confidentiality of any data that you may submit on these third party web sites. Before submitting information on such web sites, Workwear-USA LLC recommends that you read the privacy notices and other statements or policies found on these web sites.

10                 Technical requirements 

In order to be able to use and place an order in the Web Shop by making use of your computer, iPhone, iPad, Android or other device, there may be certain technical requirements. You may, for example, need to install certain software, such as any regular web browser. If your device does not meet the technical requirements, you will, via pop-up boxes or similar, get information about what software or the like that you will need to install in order to use and to place an order in the Web Shop.

11               Governing law and dispute solution 

These General Terms and Conditions are governed by Florida law, without regard to its conflict of law provisions.

Any dispute, controversy or claim arising out of or in connection with your use of or purchase from the Web Shop and/or these General Terms and Conditions, or the breach, termination or invalidity thereof, shall at first instance be settled by the Florida District Court of Appeals. This applies to any claim involving Workwear-USA LLC or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

12               Invalidity 

Should any provision of these General Terms and Conditions or part thereof be void or invalid, the other provisions of these General Terms and Conditions shall remain in force and the clause may be amended to the extent such invalidity materially affects the rights or obligations of you or Workwear-USA LLC under these General Terms and Conditions.
